1. Purpose and seller

These general terms of sale (GTS) govern sales made on the website myartvoice.com (the “Site”), operated by YOU & EYE, a French SAS with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 908 635 501, with its registered office at 60 rue du Roi de Sicile, 75004 Paris, France, EU VAT number FR02908635501, trading as MyArt.Voice (the “Seller”). Any order implies unreserved acceptance of these GTS, which prevail over any other document.

2. Products

The Site offers personalised printed artworks (“soundwave artworks”) made from an audio recording, photos and texts supplied by the customer, on canvas, Alu Dibond aluminium, acrylic or an acrylic block; related options (listening QR code, QR card, sound update, changes space); and gift cards. The Site's visuals are indicative; the preview generated in the composer corresponds to what will be printed, within manufacturing tolerances (colours, trim margins).

3. Order

The customer composes the artwork online, checks the preview, then confirms the order and payment. A confirmation email summarises the order. The Seller reserves the right to refuse or cancel an order in case of unlawful content, suspected fraud or an unusable file; the customer is then informed and refunded.

The customer warrants that they hold the necessary rights over the sounds, images and texts they supply (image rights, copyright, consent of the recorded persons) and bears sole responsibility for them.

4. Prices and payment

Prices are stated in euros, all taxes included, excluding delivery costs specified before confirmation. Payment is made online by the means offered at the time of ordering (bank cards and other displayed methods). The order is processed after payment is received. The Seller may change its prices at any time; the applicable price is the one displayed at the time of ordering.

5. Production and delivery

Each artwork is made to order. Indicative times: printing in 2 to 4 working days, then tracked delivery of 5 to 10 working days in Europe, Switzerland and the United Kingdom, and 10 to 20 working days for the rest of the world. Times run from receipt of the audio file when it is sent after the order. Any customs duties and import taxes outside the European Union are borne by the customer.

On receipt, the customer checks the condition of the parcel. In case of damage, they must report it to info@myartvoice.com within 48 hours with photos of the parcel and the artwork; the Seller then remakes the artwork or refunds it.

6. Right of withdrawal

In accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalised. Soundwave artworks and their printed options, personalised from the customer's files, are therefore firm and final once payment is confirmed.

For digital services (sound update, changes space), the customer expressly agrees that performance begins upon ordering and waives the right of withdrawal once the service has been fully performed. For unused gift cards, the customer has 14 days from purchase to withdraw, by writing to info@myartvoice.com.

7. Listening QR code and sound hosting

The listening QR code links to a listening page hosted by the Seller for the period chosen at the time of ordering (5 or 10 years), paid once, with no subscription. The customer is notified by email before expiry and may renew the hosting. The original file remains the customer's property, and a copy can be requested at any time. The Seller uses the files only to produce the artwork and to play it via the QR code; they are hosted in Europe and are neither shared nor used for any other purpose.

8. Warranties

The customer benefits from the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Minor differences in colour rendering between screen and print, and defects resulting from the files supplied by the customer (low resolution, poor-quality recording), do not constitute a lack of conformity.

9. Gift cards

Gift cards are valid on myartvoice.com only, for the statutory period from their issue, and are neither refundable in cash nor exchangeable for money, except where the right of withdrawal in Article 6 is exercised.

10. Personal data

The data collected is necessary to process the order and provide the services. Its processing is described in the privacy policy. The customer has a right of access, rectification, erasure and objection by writing to info@myartvoice.com.

11. Intellectual property

The elements of the Site (MyArt.Voice brand, texts, visuals, templates, composition software) are protected and remain the property of the Seller. The customer retains all rights over the content they supply and grants the Seller a licence limited to producing the artwork and providing the listening service.

12. Complaints, mediation and applicable law

Any complaint may be sent to info@myartvoice.com; the Seller replies within 7 working days. In accordance with Articles L611-1 et seq. of the French Consumer Code, the customer may use a consumer mediator free of charge in the event of an unresolved dispute. The customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr. These GTS are governed by French law. Failing an amicable agreement, the French courts have jurisdiction.
